By accessing or using the JJ Soul Strength website, app, member portal, or related online services (collectively, the "Services"), you agree to these Terms. If you do not agree, do not use the Services.

1. Eligibility

You must be at least 18 years old to use the Services on your own behalf, purchase coaching services, or create an account unless a parent or legal guardian has completed all required consent and contract steps for a minor participant.

The Services are not directed to children under 13. Do not create an account or submit personal information on behalf of a child under 13 without verified parent or guardian involvement and any required legal consent.

2. Scope of Services

JJ Soul Strength provides fitness, accountability, lifestyle, and coaching-related information and services. Unless expressly stated otherwise in writing, the Services are for general educational, informational, and coaching purposes only and do not provide medical care, diagnosis, treatment, mental health treatment, physical therapy, or emergency services.

Separate service-specific agreements, waivers, cancellation terms, subscription terms, and intake forms may apply to paid coaching relationships. If there is a conflict between these Terms and a signed service agreement, the signed service agreement controls for that paid relationship.

3. No Medical Advice; Emergency Situations

The Services do not provide medical advice and are not a substitute for a licensed physician or other qualified healthcare professional. Always seek appropriate medical guidance before beginning or changing an exercise, nutrition, supplementation, or wellness program.

Do not use the Services for emergencies. If you believe you are experiencing a medical emergency, call 911 or seek emergency medical care immediately.

4. Accounts and Credentials

You may need an account to access some parts of the Services. You agree to provide accurate information, keep your login credentials confidential, and notify us promptly of any suspected unauthorized use.

You are responsible for activity under your account unless caused by our own failure to maintain reasonable security. We may suspend or terminate access if we reasonably believe an account is being misused, used fraudulently, or used in violation of these Terms or applicable agreements.

6. Purchases, Plans, and Renewals

Some Services may be offered through one-time packages, recurring coaching plans, or other paid arrangements.

You agree that pricing, package structure, plan duration, features, renewal terms, cancellation rights, and refund rules may be described on the website, at checkout, in a service agreement, or in a plan-specific offer.

If a plan renews automatically or continues until canceled, the offer and checkout flow must clearly disclose the recurring nature of the plan, the amount or method of determining charges, the frequency of charges, and how to cancel. By enrolling in a recurring plan, you agree to those disclosed recurring terms.

California residents may have additional rights regarding health studio service contracts, recurring services, and cancellation. Nothing in these Terms waives rights that cannot lawfully be waived.

7. Health and Safety Responsibilities

You are responsible for using good judgment and participating only in activities that are appropriate for your health status, experience level, and medical condition.

You agree to stop exercising and seek qualified medical care if you experience pain, dizziness, faintness, chest discomfort, shortness of breath beyond normal exertion, or any concerning symptom.

Use of workout plans, demonstrations, exercise programming, or coaching guidance is at your own risk, subject to any separate written waiver or release you sign.

8. User Content and Feedback

If you submit messages, photos, videos, progress logs, nutrition information, check-ins, testimonials, comments, or other content through the Services ("User Content"), you represent that:

You retain ownership of your User Content, but you grant JJ Soul Strength a limited, non-exclusive license to host, store, process, reproduce, and use that content as reasonably necessary to operate the Services, provide coaching, maintain records, improve service delivery, and comply with legal obligations.

If we want to use a testimonial, transformation image, or identifiable content for marketing, we should obtain separate written permission unless another valid written release already covers that use.

9. Intellectual Property

The Services, including branding, copy, graphics, videos, workout structures, downloads, app interfaces, and other materials, are owned by or licensed to JJ Soul Strength and protected by applicable intellectual property laws.

Except for limited personal use connected to your own coaching relationship, you may not copy, sell, redistribute, publish, modify, or create derivative works from our materials without prior written permission.

10. Third-Party Tools and Links

The Services may use or link to third-party tools, payment processors, video platforms, analytics providers, email systems, or other services. We are not responsible for third-party websites, products, or services that we do not control.

Your use of third-party tools may also be subject to those providers' separate terms and privacy practices.

11. Privacy

Your use of the Services is also subject to our Privacy Policy, which describes how we collect, use, store, and disclose personal information.

12. Service Changes and Availability

We may update, modify, suspend, or discontinue parts of the Services at any time, including features, content, programs, and availability. We do not guarantee uninterrupted or error-free operation.

We may also update these Terms from time to time. Material changes will become effective when posted or as otherwise communicated. Continued use after the effective date of updated Terms constitutes acceptance of the revised Terms.

13. Termination

We may suspend or terminate access to the Services if you violate these Terms, misuse the Services, fail to meet payment obligations under an applicable plan, or create legal, operational, or safety risk.

You may stop using the Services at any time. Termination of site or app access does not automatically cancel a paid service agreement, recurring billing arrangement, or other contractual obligation unless those terms expressly say so.

14. Disclaimers

THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS TO THE MAXIMUM EXTENT PERMITTED BY LAW. TO THE MAXIMUM EXTENT PERMITTED BY LAW, JJ SOUL STRENGTH DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

We do not guarantee any particular fitness, health, appearance, body composition, weight loss, strength, or performance result.

15. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, JJ SOUL STRENGTH AND ITS OWNER, COACHES, CONTRACTORS, AFFILIATES, AND REPRESENTATIVES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF DATA, REVENUE, PROFITS, OR GOODWILL, ARISING OUT OF OR RELATED TO THE SERVICES.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE TOTAL LIABILITY OF JJ SOUL STRENGTH FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICES WILL NOT EXCEED THE GREATER OF: (A) THE AMOUNT YOU PAID TO JJ SOUL STRENGTH FOR THE SPECIFIC SERVICE GIVING RISE TO THE CLAIM IN THE 3 MONTHS BEFORE THE EVENT, OR (B) $100.

Nothing in these Terms limits liability that cannot lawfully be limited under applicable law.

16. Indemnity

To the extent permitted by law, you agree to indemnify and hold harmless JJ Soul Strength and its owner, coaches, contractors, affiliates, and representatives from claims, losses, liabilities, damages, and expenses, including reasonable attorneys' fees, arising out of your misuse of the Services, your breach of these Terms, or your violation of another person's rights.

17. California Consumer Rights; Contract-Specific Protections

If you purchase coaching or training services, additional California consumer protections may apply depending on the structure of the contract, including rules relating to health studio service contracts, cancellation, disability, relocation, and recurring renewals.

Nothing in these Terms is intended to waive any non-waivable consumer protection right.

18. Governing Law and Venue

These Terms are governed by the laws of the State of California, without regard to conflict-of-law rules, except to the extent superseded by applicable federal law.

Any dispute not subject to a valid alternative dispute provision must be brought in the state or federal courts located in San Bernardino County, California, and each party consents to that venue and jurisdiction.

19. Severability

If any provision of these Terms is found unenforceable, the remaining provisions will remain in effect to the fullest extent permitted by law.
